1. Acceptance of Terms

By making a booking, renting a vehicle, using our website, or using any services provided by DKS Car Hire ("the Company"), you agree to be bound by these Terms and Conditions.

2. Driver Eligibility

The renter confirms that:

• They hold a valid driver's licence.
• The licence has been held for at least two (2) years.
• They are legally permitted to drive within South Africa.
• They are at least twenty-one (21) years old.

3. Vehicle Use

Vehicles may only be used for lawful purposes.

Vehicles may not be used:

• For illegal activities.
• Under the influence of alcohol or drugs.
• For racing or speed testing.
• For off-road driving.
• For towing unless authorised.
• To transport dangerous or illegal goods.
• By any person not authorised on the rental agreement.

4. Rental Period

The vehicle must be returned on or before the agreed return date and time. Additional charges may apply for late returns.

5. Vehicle Condition

The renter acknowledges receipt of the vehicle in the condition recorded in the Vehicle Inspection Report.

The renter accepts responsibility for the vehicle during the rental period.

6. Fuel Policy

Vehicles must be returned with the same fuel level recorded at collection. Fuel shortages may result in refuelling charges and administrative fees.

7. Mileage

Mileage limitations and excess mileage charges will be specified on the rental agreement.

8. Deposit

A refundable security deposit may be required.

The deposit may be used to cover:

• Vehicle damage.
• Traffic fines.
• Fuel shortages.
• Excess mileage.
• Late return charges.
• Cleaning fees.
• Any breach of the rental agreement.

Remaining balances will be refunded after final inspection and verification.

9. Accidents and Damage

The renter must:

• Report all accidents within 24 hours.
• Report incidents to SAPS where required.
• Obtain a case number.
• Provide complete incident details.
• Cooperate with insurance investigations.

Failure to comply may result in full liability for damages and costs.

10. Insurance

Where insurance is included, the renter remains liable for any applicable excess amount.

Where insurance is declined, the renter accepts full responsibility for all losses and damages.

11. Traffic Fines and Tolls

The renter is responsible for all fines, penalties, toll fees, parking violations, and related charges incurred during the rental period.

12. Vehicle Tracking

Vehicles may be equipped with tracking devices.

DKS Car Hire may monitor vehicle location for:

• Security.
• Fleet management.
• Theft prevention.
• Vehicle recovery.

13. Termination

DKS Car Hire may terminate a rental agreement immediately where:

• False information is provided.
• Terms are breached.
• Illegal activities are suspected.
• Vehicle safety is compromised.

14. Liability

The renter remains responsible for loss, theft, damage, or misuse occurring during the rental period unless prohibited by law.

15. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

16. Changes

DKS Car Hire reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the website.
